Abstract

As a result of the convocation of a Constituent Assembly in Ecuador and the elaboration of a new Constitution in 2008, the Ecuadorian State was recast and went on to regulate aspects of genocide and crimes against humanity, among others contained in its article 80; However, it is not yet an exception to the principle of Territoriality of the Jurisdiction, such as Universal Jurisdiction. The present work directs its attention to this problem.
