Abstract

Surrogate motherhood is one in which a woman under a contract becomes pregnant so that when the child is born it will be delivered to its foster parents. The problem in this situation lies in being able to discover the necessary constitutional arguments that help understand the right of surrogate motherhood in Ecuador. The objective of the investigation is to identify the lack of constitutional norms that guarantee the rights of foster parents, since there is no norm that regulates it and they are exposed to what a contract says, forgetting the main goal that consists in the life of a human being and having a child.
