The legal security of public institutions and the guarantee of the function of the state.

Abstract

This research aims to carry out a critical and legal analysis, which will help guarantee transparency and accountability in the public sector. The methodology applied in this work was analytical - synthetic, inductive - deductive, with a qualitative approach and based on philosophical-legal and sociological-legal methods, and of a descriptive, explanatory type, and with the use of the interview. As for the population, we will have law professionals, specifically teachers and judges. It was concluded that the function of transparency and social control would be optimized if it were independent and autonomous in its decisions, as well as in its powers of control, and in terms of legal certainty, this function has clear, specific and effective regulations.
