This pedagogical discipline in its international trajectory has had a plurality of epistemological perspectives. In recent years in Chile, some debates have been generated around health and motricity where different perspectives are confronted, which have not necessarily been conceived from a plurality perspective and reflects a political conflict around the discipline and its expressions in curricular documents. Therefore, understanding dialogue as a fundamental political component, it is considered pertinent that at a national level democratic spaces for conversation and debate are generated to contribute to the development of curricular proposals representative of the collectivities that are part of Chilean Physical Education.
Sebastián Guerrero Lacoste, Felipe Mujica Johnson Copyright (c) 2024 https://dilemascontemporaneoseducacionpoliticayvalores.com/index.php/dilemas/article/view/4530 Wed, 01 Jan 2025 00:00:00 -0600 The digital divide in the context of Compulsory Secondary Education in Spain. With the advancement of AI in the creation of works of art, music and literature, questions arise about the authorship and legal protection of these productions. We analyze the evolution of AI and its impact on traditional concepts of intellectual property, especially around copyright ownership of AI-generated works. In addition, the implications for other intellectual property rights are considered, as well as the ethical challenges it poses, such as the perpetuation of biases in the data used to train AI systems.
Guido Javier Silva Andrade, Mesías Elías Machado Maliza, Stalin Daniel Cuji León, Erick Daniel Maji Gusqui Copyright (c) 2024 https://dilemascontemporaneoseducacionpoliticayvalores.com/index.php/dilemas/article/view/4583 Wed, 01 Jan 2025 00:00:00 -0600 Ethics, anthropology and bioethics; confrontation with legal systems. https://dilemascontemporaneoseducacionpoliticayvalores.com/index.php/dilemas/article/view/4585
Bioethics has become crucial, considering aspects such as: the labor responsibility of health actors, the increase in diagnostic tests compared to therapeutic probabilities, the new understanding of health and disease, and the ideological conception of the term "person" ; Therefore, this research focuses on identifying the philosophical and epistemological foundations that guide the actions of health personnel against bioethical dilemmas, especially in situations of high human vulnerability. It is intended to find ethical principles that guide medical behavior in such circumstances, helping to discern between good and bad, the right and wrong, and the fair and unfair, when human life is at stake and depends on biomedicine.
Edison Joselito Naranjo Luzuriaga, Bolívar David Narváez Montenegro, Pablo Ermely Espinosa Pico Copyright (c) 2024 https://dilemascontemporaneoseducacionpoliticayvalores.com/index.php/dilemas/article/view/4585 Wed, 01 Jan 2025 00:00:00 -0600 Traffic Infractions in Ecuador: Intentional or Not? https://dilemascontemporaneoseducacionpoliticayvalores.com/index.php/dilemas/article/view/4586
Traffic accidents can cause death and leave permanent after-effects on people, as well as physical damage to vehicles. This research aims to analyze intent in the context of traffic violations in Ecuador. A qualitative methodology was used, as well as inductive-deductive methods to collect data. It was concluded that violations for driving under the influence of alcohol should not be considered culpable. Drunk drivers often overestimate their skills and underestimate the risks, leading to the conclusion that intent is evident; therefore, Ecuadorian legal regulations should be updated to recognize eventual intent in such cases.
Mesías Elías Machado Maliza, Arleth Samantha Amaya Tuarez, Gabriela Nicole Bravo Galárraga, María Fernanda Yánez Usca Copyright (c) 2024 https://dilemascontemporaneoseducacionpoliticayvalores.com/index.php/dilemas/article/view/4586 Wed, 01 Jan 2025 00:00:00 -0600 Contemporary approaches in the defense of the existence, autonomy and well-being of Ecuadorian fauna. https://dilemascontemporaneoseducacionpoliticayvalores.com/index.php/dilemas/article/view/4587
This study has been aimed at analyzing the legal framework of Ecuador, Colombia and Bolivia regarding the recognition of animal rights and its influence on public policies on animal welfare. A comparative analysis of the legislation in each country was carried out by reviewing the regulations, implementations and challenges associated with the recognition of animals as sentient beings. Therefore, it has been concluded that the protection of animal rights in Ecuador requires adapting a legislative approach at the level of that implemented in Colombia. At the same time, the judicial and educational infrastructure must be strengthened to achieve a successful implementation of animal welfare regulations.
Valeria Alejandra Usinia Morales, Carlos David Cepeda Luna, Pablo Ermely Espinosa Pico Copyright (c) 2024 https://dilemascontemporaneoseducacionpoliticayvalores.com/index.php/dilemas/article/view/4587 Wed, 01 Jan 2025 00:00:00 -0600 Analysis of the regulation of prostitution and its influence on human rights. https://dilemascontemporaneoseducacionpoliticayvalores.com/index.php/dilemas/article/view/4588
Different cultural, social, and legal visions are manifested in the diversity of regulations on prostitution in different countries. There are three main approaches: criminalization, legalization and decriminalization. Many countries opt for criminalization, seeking to eliminate prostitution through legal sanctions. However, this strategy often marginalizes sex workers, exposing them to abuse and limiting their access to health and justice services. Legalization, on the other hand, integrates sex work into the formal economy, providing legal protection, although its success depends on proper implementation. Decriminalization eliminates legal sanctions and adopts a more humane approach. This research analyzes these approaches and their impact on hum an rights.
Wendy Natalia Toapanta Gamboa, Carlos Alberto García Valle, Juan José López García, Alfonso González Iruma Copyright (c) 2024 https://dilemascontemporaneoseducacionpoliticayvalores.com/index.php/dilemas/article/view/4588 Wed, 01 Jan 2025 00:00:00 -0600 The effect of efficient collaboration in the criminal field in the achievement of justice in Ecuador. https://dilemascontemporaneoseducacionpoliticayvalores.com/index.php/dilemas/article/view/4589
Effective cooperation in criminal matters is key to the Ecuadorian judicial system, helping to solve complex cases and combat organized crime and corruption.
