Failure to comply with the visitation regime and its violation of the right to family life.

Abstract

When the marriage is over, the Judge entrusts the tenure or parental authority to a parent who will remain in the care and custody of the children and regulates the visitation regime of the parent who does not have custody of the child. In this investigation, the authors have analyzed a judgment which observed how it influences a parent's refusal in the fulfilment of the visitation regime and the infringement of the right to family coexistence.
