Legal responsibility of physicians in the surgical room.
Abstract
Informed consent, or the “informed procedure” was born in the Declaration of Helsinki of 1964, as a treaty to carry out experiments with humans, by means of it, the patient or subject expresses his willingness to participate in a medical investigation. Carrying out an analysis of the legality and of the existing forms of the informed consent act is the objective of this investigation that highlights that informed consent like any other pre-designed document that lacks the essential elements such as negotiation and it is observed that it violates the traditional essence of contract.
