Abstract
The Legal Defense is important, because there are defendants who, given their economic and procedural situation, require the representation of these lawyers. The current procedural legislation is not sufficiently foresight or regulatory of the institution of ex officio lawyer that allows the development of a true technical defense with the rights and guarantees established for a trial attached to the due criminal process; therefore, the objective is to reveal the legal and objective limitations that ex officio lawyers present in practice, so as to provide a solution to this problem.
