Application of the conditional suspension of the penalty in the abbreviation procedure and the principles of simplification, celerity, effectiveness and effective judicial guardianship.
Abstract
The scope of justice is the fundamental duty of the State in a struggle for the defense of citizens' rights and processes where it is necessary, fair and democratic that the basic guarantees enshrined in our Magna Carta are respected. The work is aimed at providing a legal critique of the application of constitutional rights, the purpose of which is to ensure compliance with the due process of law enshrined in the Constitution of the Republic. To that end, it is proposed to provide theoretical and conceptual content that will make it possible to prepare a critical legal essay highlighting the inadequacy of the legal rules governing the application of the conditional suspension of sentences in summary proceedings as a constitutional right of the accused and the victim.
