Criminal law of the enemy
Abstract
The criminal law of the enemy is a new way of thinking for many, but it really is not.This legal philosophical current has a large number of people who defend it especially in Germany and Spain, where they have come to shape it in their legal regulations. This article analyzes the same based on the theory that supports it. For this, authors such as Jakobs, Kant, Rosseau, Fichte, Hobbes, Locke among others are considered, in the same way it is established who are considered enemies by a State and who are the citizens.
