Abstract

People have a set of rights represented by the state to guarantee their main needs. A vulnerable sector of society is represented by the elderly, for whom different legal norms have been enacted in Ecuador to guarantee their protection. However, studies have shown the inapplicability in the civil code of the guarantees established as basic needs for older adults. The objective was to conduct a study on the inapplicability in the civil code in relation to the basic needs of older adults in Ecuador. A description is made of the main perspectives on the abandonment of the elderly as a form of inapplicability in the civil code. Finally, a set of measures to support the elderly is proposed.
