Abstract

The general purpose of this article was to carry out a critical analysis of the anti-drug legal system against Drug Trafficking, comparing Ecuadorian and Venezuelan legislation. The research is analytical type, with a qualitative approach, the method used is the legal hermeneutic, the applied design is cross-sectional and documentary-bibliographic, the results obtained were achieved thanks to the triangulation of the information obtained from the legal texts and the interviews. in-depth information on key informants in the area. The present work allowed to conclude that there are serious discrepancies in the legal assumptions formulated by both laws on drug trafficking, since the current Ecuadorian legal system is decontextualized with respect to the international legal framework.
