Abstract

The objective of the research is to analyze the supremacy of morality over procedural legality from the investigative powers of the judge in relation to morality and legality, establishing alternative dispute resolution mechanisms before resorting to ordinary justice. It was necessary to develop a quali-quantitative cross-sectional investigation with the use of research tools such as the survey, obtaining as a result that legality and morality are different concepts within the regulatory framework. In the bibliographic background, it is possible to reaffirm the relevance of exhausting alternative means of conflict resolution that allow greater flexibility in decision-making attached to moral aspects rather than legality.
