The guarantee of motivation in sentences of abbreviated procedure in the Canton of Santo Domingo.
Abstract
The motivation of sentences constitutes a guarantee of due process, which must comply with minimum standards and parameters with sufficient grounds so that there is no violation of rights. The objective of this study is to demonstrate the violation of the guarantee of motivation in the sentences of abbreviated procedure in the crimes of robbery in the Judicial Unit of Criminal Guarantees based in the canton of Santo Domingo. The research was carried out from the qualitative-quantitative approach allowing to obtain results about the violation of the motivation in more than 50% of abbreviated procedure sentences. It was concluded that it is necessary to establish continuous training workshops for judges regarding the motivation of sentences in abbreviated procedures.
