Abstract

The health network personnel are configured as public servants; however, the law cannot be violated, and people cannot be exploited in order to maintain a service permanently in force, and this is what happened with resolution No. 90 of the National Technical Secretariat of Ecuador in the year 2000. 90 of the National Technical Secretariat of Ecuador in 2009, when despite the fact that the regulation establishes that those public servants who perform dangerous work, or work at night, will have the right to special working hours of shorter duration, without justification, and under administrative resolution, the working day was increased from 120 to 160 hours, maintaining the same remuneration, this under the argument that health is a service that cannot be suspended, which implies a violation of rights for health personnel.
