The approval, its causes and the technical standards that regulate its procedure according to the Ministry of Labor.

Abstract

Work is constituted as a social right and duty; With these circumstances of a legal nature, we will carry out a legal, doctrinal and critical study of the Approval process in accordance with the Labor Code in order to establish its legal effects against an administrative and judicial action, by virtue of the causes determined in the articles 172 and 173 of the Labor Code and in relation to the ministerial agreement MDT-2021-189 issued by the Ministry of Labor. The research is qualitative with a non-experimental design using analytical-synthetic methods; inductive-deductive and documentary analysis; applying documentary review techniques and the interview, resulting in the ministerial agreement presenting certain legal inconsistencies.
