Abstract

This paper analyzes the execution phase of the sentence, in order to understand the crisis in prisons due to overcrowding and confrontation with organized crime. The objective is to identify the deficient public policies implemented by the State that generated the precarious prison situation. For the above, the direct experimentation of the phenomenon of insecurity and power struggle that takes place in Ecuadorian prisons is addressed. The analysis of the statistics of the body in charge of social rehabilitation will establish the collapse of the rehabilitation system, considering as a possible solution to the phenomenon urgent reforms to the Comprehensive Organic Penal Code, the minimum criminal intervention and the need for pardon of those deprived of liberty.
