The right to Due Process and effective judicial protection of legal persons in the Ecuadorian constitutional law.
Abstract
Among the rights of legal persons is Due Process, an abstract and autonomous right that constitutes the central element of the rule of law and requires the existence of independent jurisdictional bodies and procedures that limit the actions of justice administrators. The investigation responds to the documentary modality. As a result, it was possible to determine when analyzing the legal nature of the right to Due Process from the latu sensu perspective, the 2008 Constitution excludes legal persons from the right to due process. As conclusions, it is established that the State through the legal system grants rights and obligations to legal entities that guarantee the fulfillment of the purposes of these organizations.
