Abstract

This article analyzes the principle of double compliance in traffic offenses with non-custodial penalties in Ecuadorian legislation; for which it is questioned: how does the limitation established by the Organic Comprehensive Criminal Code affect the principle of double compliance in traffic offenses with non-custodial penalties? To answer this question and understand the effect on the enjoyment of the right to file appeals of citizens against the State. The research is a non-experimental study, with a qualitative approach, framed in the documentary modality; by virtue of the fact that the necessary information for the analysis of the application of the principle of double compliance in traffic offenses with non-custodial sentences was obtained from electronic and written sources. Finally, it is concluded that the lack of application of the double agreement is unconstitutional.
