Abstract

Undoubtedly, the topic is of great interest, so the objective of the research is to confront the phenomenology of passive pluriofensivity versus victimological etiology. The research has as its strength a favorable solution to the problem posed in vindication of the crime victim. It seeks to offer a real integrity to the penal system, by providing prophylactic measures to mitigate the injury. The aim is to provide the victim and witnesses in the criminal proceeding with full legal admission to the integral program of protection under police custody, also for the sake of safeguarding them, thus promoting the denunciation and avoiding the access of the crime to the black list on the margin of the law in impunity of the active subject and to the detriment of the social collective.
