Analysis of the prison crisis and preventive detention as a precautionary measure.

Abstract

The objective of this investigation is to analyze the abuse of pretrial detention as a precautionary measure, despite the prison crisis. The work was carried out thanks to the bibliographic method, searching for information in various documents and files in which an exhaustive study on the subject to be dealt with was achieved; In addition, the analytical-synthetic method was applied to examine the criminal and constitutional norms. After carefully observing all the information collected in this work, it was concluded that preventive detention is one of the main causes of the prison crisis, since this measure is sometimes applied to people who commit crimes or minor infractions.
