Abstract

The Constitution of Ecuador established the recognition of nature as a subject of rights; This represents a great legal innovation, since they not only ensure the protection and well-being of people but also of all living organisms on the planet. The objective of the investigation is to generate norms that guarantee the defense and care of all living beings, and that the State has the obligation to adjust its public policies and its laws so that the full rights of all animals as sentient beings are fulfilled. that they have rights and must be fully protected, analyzing article 585 of the Ecuadorian Civil Code, in the light of neo-constitutionalism.
