Legal analysis on the current panorama in Mexico of the Criminal Responsibility of legal collective persons and objective 16 of the 2030 Agenda for Sustainable Development
Abstract
As of June 17, 2016, Criminal Law has evolved to penalize the liability of legal collective persons; u ntil that date, only natural persons were subject to criminal liability. The conservative Mexican legal doctrine does not conceive the idea of being able to criminally reproach legal persons, considering the aphorism societas delinquere non potest (society cannot commit a crime), for which they cannot and lack the elements to be judged. It is now a reality to be able to assign criminal liability to legal en tities, after a long debate on whether or not it is correct to do so.
