The protection of human rights through legal safeguards: An analysis of the regulatory guaranteed mechanisms.

Abstract

The proposed research aims to analyze normative guarantees as fundamental mechanisms for the protection of human rights. These guarantees are established to intervene in cases of violation of fundamental rights and are based on the constitutional regulations that support the legal system of the Ecuadorian State; however, it is evident that this legal figure by itself is not enough to guarantee the effective protection of the rights of citizens. The normative power falls on the National Assembly, as an exclusive competence to adapt the infra-constitutional laws to the supreme norm. It is important to remember that rights should not be simply stated in catalogues but enforced and protected in practice.
