The ineffectiveness of the dismissal and the safeguarding of the rights of the father in relation to the next birth of his son.
Abstract
The research contributes significantly to the existing literature on unfair dismissal by carefully examining the circumstances in which dismissal is considered unfair or unfair, and its consequences for the employer as well as the employee. Both qualitative and normative approaches to better understand ineffective dismissals are discussed and relevant labor laws and regulations are assessed. In the context of Ecuador, the Labor Code regulates ineffective dismissal, granting compensation rights and the possibility of challenging the dismissal decision. This research provides a solid basis for understanding and protecting the rights of workers affected by ineffective dismissals, promoting a fairer and more equitable legal framework in the workplace.
