The influence of hyper-guaranteeism in the operation of the social rehabilitation center in the city of Santo Domingo and its consequences.
Abstract
This study focuses on the analysis of the protection of the rights of persons deprived of liberty in Ecuador, considering the importance of guaranteeing their human dignity during the judicial and rehabilitation process. For this, a qualitative and quantitative investigation was carried out that included the technique of surveys and interviews, as well as a bibliographic review to investigate the doctrine of hyper-guaranteeism and its application in the Ecuadorian context. The results obtained reveal that the excessive protection of the rights of those deprived of liberty has generated an effect of hyper-guaranteeing in the judicial system, which hinders the effective application of justice in cases of citizen insecurity.
