Abstract

In the context of crimes of intrafamily violence and the application of the abbreviated procedure, the opinion and pronouncement of the victim acquire a fundamental relevance since they influence the decision of the court on the acceptance or rejection of said procedure in favor of the accused. In the investigation carried out, an exhaustive review of the doctrine, jurisprudence and criminal procedure regulations was carried out, revealing that the regulations that regulate the application of the abbreviated procedure in cases of intrafamily violence do not offer clarity regarding the position of the victim. In conclusion, it is essential to establish a clear regulatory framework that defines and protects the role of the victim, making it possible to safeguard her rights. guaranteeing her active participation in the criminal process.
