Impeachment: its role as a control mechanism and potential source of power imbalance.
Abstract
This critical essay focuses on analyzing the effectiveness of the figure of impeachment in Ecuador, given its growing prominence in the political discussion, especially following the decree of "cross death" by President Guillermo Lasso Mendoza. The objective is to understand the functioning and purposes of this type of trial in the context of power relations and the counterweights inherent to it. The distinction between impeachment and criminal or civil trials will be addressed, despite the fact that the latter two are the most recognized in legal doctrine. In addition, we will consider whether impeachment contributes to the control of executive actions or whether, on the contrary, it generates a significant imbalance in state power.
