Analysis of Judgment N°22-18-IN/21: evaluation of the effectiveness of environmental judicial decisions
Abstract
This legal analysis focuses on the rights of nature in Ecuador and the tension between economic development and environmental protection. The study examined contradictions in environmental regulations, especially in case No. 22-18-IN/21, and advocated for a holistic ecological perspective in the legal system. A methodology was used that combines qualitative and quantitative approaches, analyzing in detail sentence No. 22-18-IN/21 and other relevant judicial documents; Semi-structured surveys were used to assess the impact of the ruling in terms of environmental protection, highlighting the need for a more comprehensive legal approach and the importance of balancing economic development with environmental protection in Ecuador.
