Comparative evaluation of evidence: focus on material truthfulness vs. formal truthfulness.
Abstract
This study exhaustively analyzes the evaluation of evidence in judicial processes, addressing both the perspective of procedural truth and material truth, collecting information from documentary sources that focus on the evaluation of evidence from the formal and material approaches. The research method is qualitative, examining how the assessment of evidence is applied in relation to the notion of truth in the context of judicial processes and depending on the specific matter involved. In conclusion, it is highlighted that truth is a broad and complex concept, especially in the judicial field, referring to what can be demonstrated with the incorporation of sources and means to establish it or get closer to it.
