Precautionary measures to protect the labor rights of people with catastrophic, terminal, and rare diseases in Ecuador.
Abstract
In Ecuador, catastrophic diseases have constitutional support and priority attention to protect the rights to health and work of those who suffer from them, but the lack of a specific legal framework relating the right to work and catastrophic diseases is evident. A study carried out in Guayaquil seeks to propose legal reforms to strengthen the protection of the labor rights of this population. The analysis examined current legislation, court cases and international recommendations, identifying deficiencies in the application of these rights. Expert judgment was used to support the formulation of reform proposals to the Labor Code, with the aim of improving the protection of the rights of those facing catastrophic illnesses in Ecuador.
