Standards of preventive detention in the constitutional framework of Peruvian procedural law.
Abstract
The objective of this research is to systematically analyze the standards of preventive detention in the constitutional framework of Peruvian procedural law by summarizing the various scientific evidence available found in the different databases of legal journals. From this postulate on the scope of criminal law it can be inferred that preventive detention is framed in the Peruvian constitution of 1993 and in accordance with the provisions of the American convention on human rights. Therefore, the most important jurisprudence issued by the highest Peruvian constitutional court denotes an exhaustive analysis of how its rules can be applied independently and based on the conformity interpretation of the procedural code.
