Abstract

The research addresses family crises triggered by divorces and separations, with a focus on determining custody of children, especially when they are under 12 years of age. It seeks to carry out an in-depth legal analysis with the intention of proposing reforms to article 106 of the Code of Children and Adolescents in Ecuador. The methodology includes interviews with experts and surveys of people involved in similar situations. The custody of children after divorce is considered an equal right for both parents; However, the research emphasizes the need to consider the Principle of the Best Interests of the Child when issuing custody decisions.
