Abstract

The principle of motivation is crucial in due legal process, particularly in disciplinary procedures of the National Police. The investigation seeks to evaluate compliance with the principle of motivation in the sanctioning resolutions of the National Police, using a mixed approach that combines documentary analysis with field data. The main result is based on the analysis of judicial cases related to legal protection actions, which have revealed breaches of due process, especially in the motivation of disciplinary decisions. In summary, the need for continuous training in legal areas for the authorities in charge of disciplinary processes in the National Police is emphasized, thus guaranteeing the fair and well-founded application of the law.
