Abstract

The research focuses on the right to digital disconnection in the workplace, allowing workers to decide whether to respond to their employers' requests outside of working hours without sanctions. National and international labor regulations are analyzed, using research methods such as analysis-synthesis and the exegetical approach, highlighting the divergence between European and Latin American countries, with France and Spain being examples of regulations prior to the COVID-19 pandemic that benefit everyone. workers, including managers. In contrast, Ecuador and other Latin American countries limit this right to teleworking workers. Emphasis is placed on learning from the European experience to harmonize labor regulations in Latin America.
