A legal study of cryptocurrencies in the framework of the protection of legal rights.
Abstract
This study analyzes the regulation of cryptocurrencies in Ecuador, especially in the Securities Market Law, with the aim of ensuring respect for the right to legal certainty established in the Ecuadorian Constitution. The study highlights essential elements of cryptocurrencies, their nature, risks, benefits, importance in the Ecuadorian legal context and their lack of specific regulation in Ecuador through qualitative research methods. There is a need to enact legal regulations that include them in the Securities Market Law and other relevant laws. It concludes with key findings and perspectives for decision-making and policies related to the regulation of cryptocurrencies in Ecuador.
