Analysis of the regulation of electronic signatures in Latin America: a comparative approach.

Abstract

The present investigative work carried out a legal and critical analysis focused on the role of the legislator in Ecuador as the agent in charge of creating regulations that adequately respond to technological advances and social changes. Through a comparative analysis, regulatory parameters were identified that allowed us to propose improvements aimed at updating and perfecting the Ecuadorian legal framework that governs electronic signatures. Outstanding aspects of Colombian and Argentine regulation were highlighted. This analysis is based on a qualitative investigation that covered legal examination, bibliographic study and critical interpretation of various regulations related to electronic signatures in Latin America and Ecuador.
