Características de la jurisdicción arbitral y la solución de conflictos entre estados desde la perspectiva de los jueces y árbitros.
Abstract
The objective of the work is to analyze and compare the characteristics of arbitration jurisdiction and the resolution of conflicts between states. Through a survey directed at 100 international law professionals, their experiences, perceptions and preferences in their judicial and arbitration practice are explored. Most participants have between 10 and 20 years of experience and have an equal gender distribution and diverse representation in terms of regions of practice. Judges and arbitrators prefer arbitral jurisdiction for economic and commercial disputes due to its flexibility and efficiency. Institutions that manage these processes can use these findings to improve their procedures and increase user satisfaction.
