Influence of legal tools in streamlining judicial processes in the criminal system.
Abstract
The intersection between the abbreviated procedure and the conditional suspension of the sentence has gained relevance in the Ecuadorian criminal system. These legal instruments have been used to streamline judicial procedures and address prison overcrowding. This study analyzed the joint application of these instruments, evaluating the impact on rehabilitation, judicial efficiency and the reduction of overcrowding, while respecting constitutional rights. The results indicated that the correct implementation of these instruments has favored the social reintegration of those convicted and contributed to a more agile judicial system. However, violations of the principle of equality before the law were observed, requiring firm respect for constitutional rights to improve restorative justice in Ecuador.
