Legal study on the regulation and consequences of the legal malpractice
Abstract
The administration of justice in Ecuador is crucial to the rule of law and the protection of citizens’ rights; however, trust in the judicial system has declined due to malpractice by some lawyers. The 2009 Organic Code of the Judicial Function (COFJ), whi ch regulates legal practice and protects rights, needs to be reformed to address these shortcomings. The proposed reforms include the creation of specialized courts, a mandatory registration of lawyers, and stricter sanctions. These measures seek to strengthen control over professional conduct, improve transparency, and restore public trust in the judicial system. The research highlights the urgency of these reforms to ensure ethical and effective legal practice.
