Exploring the effects of revictimization on parental custody restitution.
Abstract
The restitution of parental authority in Ecuador has shown regulatory inconsistencies that affect the rights of minors. This study focused on analyzing the gaps in the Organic Code of Children and Adolescents in relation to the restitution of parental authority. As well as proposing reforms that guarantee comprehensive protection and prevent the restitution of this right in cases of recidivism in serious cases. Through surveys and interviews with legal professionals and family judges, the need for clear changes in legislation was identified. In conclusion, the suggested reforms would prioritize the best interests of the child, strengthen their protection and avoid situations of revictimization, by ensuring their well-being.
