Abstract

A systematic review of the complementary megastructures of the criminal types and their relevance in the determination of circumstances that modify the penalties for specific aggravating factors was carried out. The main objective was to highlight the legal framework beyond the normative precept, considering legislative selectivity as a political act in the creation of the criminal law. The methodology was based on the phenomenological paradigm, with a qualitative approach and inductive analysis. The protected legal goods were examined, showing the normative evolution of the penal articles. It was concluded that the philosophy of criminal law is interested in the meaning and justification of law, differentiating between minor infractions and serious crimes.
