Traffic Infractions in Ecuador: Intentional or Not?
Abstract
Traffic accidents can cause death and leave permanent after-effects on people, as well as physical damage to vehicles. This research aims to analyze intent in the context of traffic violations in Ecuador. A qualitative methodology was used, as well as inductive-deductive methods to collect data. It was concluded that violations for driving under the influence of alcohol should not be considered culpable. Drunk drivers often overestimate their skills and underestimate the risks, leading to the conclusion that intent is evident; therefore, Ecuadorian legal regulations should be updated to recognize eventual intent in such cases.
