Abstract

The principle of the best interest of the child is essential to ensure the well-being and protection of the rights of children and adolescents in all decisions that affect them. This study analyzed the impact of parental alienation on the development of minors, whose rights are violated within their family unit. Inductive-deductive, legal-analytical and legal comparison methods were used, allowing for a detailed analysis. The findings of the “Nosotras con Equidad” Foundation show violations of fundamental rights and the need to reform the Code of Childhood and Adolescence to classify parental alienation, thus comprehensively protecting minors.
