Childhood and the criminal justice system.
Abstract
This research focuses on a critical analysis of the legal conception of children and its complex interaction with contemporary criminal and penitentiary law frameworks. Centrally, the study seeks to elucidate the inconsistency between international norms, which define the age group, and national regulations, which have a different perspective. This disparity is of paramount importance, since the legislation applicable to this vulnerable population must not only guarantee their full rights but also establish their obligations and the rigorous system of juvenile criminal responsibility. Understanding and harmonizing these disparate perspectives is essential for establishing a specialized, comprehensive, and coherent justice system.
