Socio-legal analysis of the effects of the food debtor certificate before the Institute of the Registry Function of the State of Mexico.
Abstract
The food debtor certificate is applied to those who fail to comply with the obligation to grant maintenance; the decree that creates said certificate contains serious legal omissions, since it does not distinguish between an annotation or inscription in the property owned by the debtor, also granting the exemption in the payment of fees for the services provided by the Registry Offices in the Civil Code of the State of Mexico, but forgetting that there is no express provision in the fiscal legislation that grants any benefit to this case; these errors put at risk the legal effects that are intended to give such a lien since they leave the defendant in a state of defenselessness.
