Abstract

In Ecuador, the female gender has historically been discriminated against in various  fields such as labor, salary, social, and equal opportunities in the Constitution of the Republic of Ecuador there are significant changes for the benefit of pregnant women and their breastfeeding period, considering it within of the priority care group. The objective of the study was to determine whether private sector workers receive an unjustified differential treatment compared to those of the public sector, at the time of accounting for their lactation period, for which documentary and field research was used, the results of which allowed to show that the differentiated treatment that the legal norm gives to this same group of people lacks an objective and reasonable justification.
