Criminal judges and their lack of impartiality in direct proceedings.

Abstract

This article seeks to analyze the lack of impartiality of judges, the introduction of special procedures that favor speed to the detriment of the Penal Guarantee established in the Constitution. The direct procedure is in opposition to the basic guarantees of due process, denoting the lack of impartiality of the first level Judge, considering as a possible solution the application of the direct procedure in urgent reforms to the Comprehensive Organic Criminal Code, to establish the minimum criminal intervention and the need for the implementation of fair trials.
