Abstract

This research focuses on the change of focus on the rights of nature, moving from a focus on the object to one on the subject; change that goes beyond legal regulations and requires community awareness and responsibility. The Constitution of Montecristi marks progress by recognizing the rights of nature, emphasizing respect and the right to restoration, with the possibility of protecting them through judicial guarantees. In the work, the importance of understanding the territory as a limitation to implement these constitutional provisions is highlighted. It is analyzed the case of the Chibunga River, where pollution is a problem aggravated by the lack of public policies of the Municipal Decentralized Autonomous Government of Riobamba.
