New horizons of Neoconstitutionalism: addressing the emerging challenges of Neurorights.
Abstract
Neoconstitutionalism is a theoretical current that emphasizes the importance of the Constitution as a fundamental source of the legal system; On the other hand, neurorights refer to the set of rights related to the brain, mind and neuroscience. Although both concepts have implications in the legal and constitutional field, neoconstitutionalism focuses on the protection of fundamental rights and the interpretation of the Constitution, while neurorights focus on rights related to the brain and neuroscience; Therefore, this research aims to provide a theoretical approach to the new challenges of Neoconstitutionalism in the face of Neurorights, in order to understand the importance of these concepts within modern constitutionalism.
