Interaction between public administration and the guarantee of citizen rights.
Abstract
Positive administrative silence in Ecuador has constituted a key mechanism in the relationship between citizens and the public administration; therefore, this study has focused on analyzing its implementation, by identifying legal gaps present in the regulation in the Organic Administrative Code and the General Organic Code of Processes. Likewise, propose solutions that strengthen the protection of rights and improve administrative efficiency. To this end, a qualitative approach and a documentary review were used, where regulatory deficiencies that limit the effectiveness of the mechanism were identified. In addition, it was concluded that legal reforms aimed at improving legal security and citizen perception of public administration are necessary.
